Terms of Use

These terms are the agreement between you and Froggy Eye Ltd for the ApexRoute mobile app. Installing or using the app means you accept them.

1. The agreement

ApexRoute ("the app") is published by Froggy Eye Ltd, a company registered in the United Kingdom ("we", "us", "our"). These Terms of Use, together with our Privacy Policy, form the agreement between you and us for your use of the app.

If you do not agree to these terms, do not install or use ApexRoute. If you already have, uninstall it.

2. Your licence to use ApexRoute

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use ApexRoute on devices you own or control, for your own non-commercial use, in accordance with these terms and with the rules of the app store you obtained it from.

You must be old enough to form a binding contract where you live, and you must hold a valid driving licence for any vehicle you drive while using the app. You may not sublicense, resell, rent, reverse-engineer, decompile or modify the app, or attempt to extract its source code, except to the extent that applicable law expressly permits it.

3. Driving safety — your responsibility

Do not operate ApexRoute while driving. Set up your route, start a recording, and mount your device before you move off. Interacting with a phone at the wheel is dangerous and is an offence in the UK and in many other places.

You are solely responsible for how you drive. ApexRoute suggests roads; it does not drive the car. You must at all times obey speed limits, traffic signs, road markings and the law, drive within your own and your vehicle's capabilities, and adapt to the conditions in front of you.

ApexRoute is designed around enjoyable, winding and scenic roads. That is not an invitation to drive quickly, to race, to time yourself, or to treat the public road as a circuit. Nothing in the app should be read as encouraging you to break the law. Drive-recording statistics such as speed are a record of what you did, not a target to beat.

4. Routes and map data are suggestions, not instructions

Routes are generated from third-party mapping and routing data, which is not guaranteed to be accurate, current or complete. Roads may be closed, restricted, private, seasonal, unsuitable for your vehicle, or unsafe. GPS positioning can be inaccurate or unavailable.

ApexRoute is not a turn-by-turn navigation system and is not a substitute for one, nor for your own judgement or for official road signage. Always check that a suggested route is legal, appropriate and safe before you drive it, and abandon it if conditions say otherwise.

Routes, recorded drives, photos, videos, audio and notes you create in ApexRoute are yours. They are stored on your device and we neither receive nor host them, so we claim no licence or ownership over them.

Because your content lives only on your device, keeping it safe is your responsibility. Deleting the app, losing the device, or resetting it will remove that data permanently, and we cannot recover it for you.

You are responsible for having the right to capture and store any photo, video or audio you record — including the consent of anyone identifiable in it.

7. ApexRoute Pro, subscriptions and auto-renewal

ApexRoute is free to download and includes a free tier with daily and storage limits. ApexRoute Pro removes those limits and is offered in three forms:

All purchases are processed by the Apple App Store or Google Play, not by us. Prices are shown in the app in your local currency before you buy, and are the prices held by the store at that moment.

Auto-renewing subscription terms. Payment is charged to your Apple ID or Google Play account at confirmation of purchase.

Subscriptions renew automatically for the same period at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.

You can manage your subscription and turn off auto-renew in your account settings after purchase: on iOS, Settings › [your name] › Subscriptions; on Android, Google Play Store › Payments & subscriptions › Subscriptions. Deleting the app does not cancel a subscription.

If a free trial or introductory offer is available, any unused portion of a free period is forfeited when you buy a subscription. The Lifetime option is a one-time purchase and does not renew.

Pro is tied to the store account that bought it, and can be restored on your other devices using that account via "Restore Purchases". Prices may change; where a change affects a subscription you already hold, the store will notify you and, where required, ask for your consent before the new price applies.

8. Cancelling and refunds

You can cancel a subscription at any time through your store account, as described above. Cancelling stops future renewals; Pro remains active until the end of the period you have already paid for, and part-periods are not refunded except where the law requires it.

Refunds are issued by Apple or Google under their own policies, not by us — we have no ability to refund a store purchase. Contact Apple Support or Google Play Support. If you are a UK or EU consumer, your statutory cancellation and refund rights are unaffected by anything in these terms.

9. Intellectual property and third-party data

ApexRoute, its name, logo, design and software are owned by Froggy Eye Ltd and protected by intellectual property law. These terms grant you a licence to use the app, not any ownership of it.

Map and routing data comes from third parties and remains theirs, subject to their licences and terms — including OpenStreetMap contributors (ODbL), Google Maps/Google Earth Additional Terms of Service, and TomTom. By using ApexRoute you also agree to comply with those terms where they apply to you.

10. Availability and changes to the app

We may add, change, suspend or remove features, and we may stop supporting older operating system versions or devices. Features that depend on third-party mapping services may degrade or stop working if those services change, rate-limit, or become unavailable — that is outside our control.

If we discontinue a paid feature you currently hold a subscription to, we will handle it fairly and in line with consumer law.

11. Disclaimers

Except for the warranties that cannot be excluded under the law of your country, ApexRoute is provided "as is" and "as available", without warranties of any kind. We do not warrant that the app will be uninterrupted or error-free, that generated routes will be accurate, legal, passable or suitable for your vehicle, or that location and mapping data will be correct.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect or consequential loss, or for loss of data, arising from your use of ApexRoute. Where we are liable, our total liability to you is limited to the greater of the amount you paid us for the app in the twelve months before the claim, or £50.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded. If you are a consumer, you keep all your statutory rights, including under the Consumer Rights Act 2015.

We are not responsible for driving decisions you make, for traffic offences you commit, or for damage, injury or loss arising from how you drive a route.

13. Termination

You may end this agreement at any time by uninstalling the app. We may suspend or end your licence if you materially breach these terms — for example by tampering with purchase verification or using the app unlawfully. Sections that by their nature should survive (intellectual property, disclaimers, liability, governing law) continue to apply after termination.

14. App Store and Google Play terms

Your use of the app is also subject to the terms of the store you downloaded it from. Where you obtained ApexRoute from the Apple App Store: this agreement is between you and Froggy Eye Ltd only, not Apple; Apple has no obligation to provide maintenance or support; Apple is not responsible for addressing any claim relating to the app; and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

15. Governing law

These terms are governed by the laws of England and Wales, and disputes will be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident elsewhere in the UK or in the EU, you keep the protection of the mandatory consumer laws of your country of residence and may bring proceedings in your local courts.

16. Changes to these terms

We may update these terms — for example when features or pricing change. The current version always lives at this address, with the effective date at the top. Continuing to use the app after an update means you accept the revised terms; if you do not, stop using the app and cancel any subscription.
